These Terms & Conditions (the "Terms" or "Agreement") govern your access to and use of www.archipelagopresets.com, including any authorized social media channels and private customer forum areas (collectively, the "Website"), and your purchase, download, or use of any digital products offered by Red Leaf Studios Inc. ("Red Leaf," "we," "us," or "our").

The Website offers Lightroom presets, ACR presets, Photoshop actions, photography guides, educational downloads, and related digital products (collectively, the "Products").

By accessing the Website or purchasing or using any Product, you agree to be bound by these Terms. If you do not agree, do not use the Website or purchase Products. If specific Product Terms are presented at checkout, those terms will govern only with respect to that Product in the event of a direct conflict. Red Leaf may update these Terms from time to time. Continued use of the Website constitutes acceptance of any updated Terms.

You must be the age of majority in your jurisdiction to enter into this Agreement. If entering on behalf of a company or other entity, you represent that you have authority to bind that entity.

Subject to payment and compliance with these Terms, Red Leaf grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the purchased Products for personal or internal business use.

Unless otherwise specified, each Product purchase includes a five (5) seat license, authorizing use by up to five (5) natural persons and/or five (5) devices within your organization. Additional seats require purchase — contact support@archipelagopresets.com.

You may not:

Unauthorized use may result in immediate license termination and legal action.

The Website and its contents are owned by or licensed to Red Leaf and protected by intellectual property laws. You agree not to use the Website or Products for unlawful purposes, to infringe intellectual property rights, to distribute malware, to scrape or harvest data, to interfere with Website security, or to harass, defame, or abuse others. Red Leaf may suspend or terminate access for violations.

Private forum areas and social channels must be used respectfully. Red Leaf may moderate, remove content, or revoke access at its discretion for conduct violating these Terms. Red Leaf is not responsible for user-generated content posted by others.

All Website materials and Products are owned by or licensed to Red Leaf. You receive a license to use Products — you do not obtain ownership rights. Unauthorized use may result in damages, legal fees, and enforcement action.

All prices are in U.S. Dollars unless otherwise stated. You are responsible for applicable taxes and foreign transaction fees. Products are delivered digitally — you are responsible for maintaining backup copies. We may restrict certain payment methods at our discretion.

Because Products are delivered digitally and immediately accessible, all sales are final, except as required by applicable law, or in cases of accidental duplicate purchases of the same Product (subject to transaction fees). No refunds will be granted for software or hardware incompatibility, failure to review Product requirements, or dissatisfaction with artistic results. Initiating an improper chargeback may result in suspension of access pending resolution.

Red Leaf may offer an optional annual Society Membership currently priced at $15 USD per year (unless otherwise stated at checkout). Society Membership provides access to a members-only homepage and may include special pricing, early access, exclusive content, or other benefits as described on the Website from time to time. Membership benefits are subject to change at Red Leaf's discretion. Red Leaf does not guarantee any minimum discount, savings amount, or frequency of member-exclusive offers.

By enrolling in Society Membership, you authorize Red Leaf (or its payment processor) to charge your selected payment method annually on a recurring basis unless canceled prior to the renewal date. The renewal price will be the then-current membership fee in effect at the time of renewal.

You may cancel at any time through your account settings or by contacting support. Cancellation prevents future renewals. Except as required by law, membership fees are non-refundable and not prorated, including if canceled before the end of the term.

Society Membership is personal to the account holder, non-transferable, and may not be resold or shared.

Red Leaf may suspend or terminate membership for fraud, abuse, or violation of these Terms. If terminated for breach, access may cease immediately and remaining membership time may be forfeited to the extent permitted by law. Product license terms remain governed by Section 2 regardless of membership status.

Support inquiries may be directed to support@archipelagopresets.com. Support is provided at our discretion. We do not guarantee compatibility with specific devices, software versions, or third-party platforms (including Adobe products). We are not responsible for third-party software performance or changes.

The Website and Products are provided "AS IS" and "AS AVAILABLE." Red Leaf disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, compatibility, and non-infringement. Results vary depending on lighting, exposure, white balance, camera equipment, file type, and editing technique. We do not guarantee uninterrupted or error-free Website operation.

To the maximum extent permitted by law, Red Leaf shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, data, business interruption, or goodwill, arising out of or relating to the use of the Website or Products, even if advised of the possibility of such damages.

Red Leaf's total aggregate liability for any claim shall not exceed the amount paid by you for the Product(s) giving rise to the claim in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Red Leaf and its officers, directors, employees, and agents from any claims arising from your breach of these Terms, your misuse of Products, or your violation of laws or third-party rights.

Red Leaf shall not be liable for any delay, interruption, or failure in performance resulting from causes beyond its reasonable control, including natural disasters, acts of government, cyberattacks, internet service interruptions, payment processor outages, third-party software failures, or labor disputes.

You represent that submitted reviews are truthful and that you have rights to submit them. Red Leaf may publish, edit, decline, or remove reviews at its discretion, including content that is profane, defamatory, spam, promotional, or unrelated to the Product. Publication does not constitute endorsement. From time to time, Red Leaf may conduct promotional giveaways related to reviews. Prizes have no cash value and are not redeemable for cash.

Your use of the Website is subject to our Privacy Policy.

This Agreement is governed by the laws of the Province of British Columbia and the applicable federal laws of Canada. You agree to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, including the Supreme Court of British Columbia and the Federal Court of Canada.

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

These Terms constitute the entire agreement between you and Red Leaf regarding the Website and Products and supersede all prior communications.

You may not assign this Agreement without prior written consent. Red Leaf may assign this Agreement in connection with a merger, acquisition, or asset sale.

All third-party trademarks remain the property of their respective owners. References do not imply endorsement unless expressly stated.
